The Garda Compensation Scheme

Members of An Garda Siochana who sustains an injury while carrying out their duties may seek compensation from the Department of Justice under the Garda Siochana (Compensation) Acts 1941 and 1945. When a member has been fatally injured while on duty, their dependents can also bring a cause of action under this legislation.

To seek compensation, the injury suffered by the member must be maliciously inflicted upon them and must not be deemed to be a “minor injury” or have occurred when the member was assigned to duties which were of “special risk”.

An application must be submitted within three months of the date of injury to the Department of Justice. This is a very short time frame within which to submit the application however, it is possible for this period to be extended in exceptional circumstances.

At Tormeys Solicitors LLP we will advise you in determining the validity and strength of your cause of action bearing in mind the specific circumstances of your incident. We have advised Gardai in cases involving the most serious physical and psychological injuries and have successfully recovered damages for numerous members.
